Terms & Conditions
Bookings & Payments
A booking is confirmed once the required payment has been received.

25% of the total course or activity fee is payable at the time of booking to secure the booking.

50% of the total course or activity fee must have been paid no later than 6 weeks before the course or activity start date.

100% of the total course or activity fee must have been paid no later than 4 weeks before the course or activity start date.

For bookings made within 6 weeks of the start date, 50% of the total fee is payable at the time of booking.

For bookings made within 4 weeks of the start date, the full fee is payable at the time of booking.

If a payment deadline is not met, PASSGC reserves the right to cancel the booking and offer the place to another client.

Prices and payment requirements will be clearly stated at the time of booking. All prices are quoted in euros unless otherwise stated.
Course Suitability, Preparation and Requirements
PASSGC aims to ensure that clients are booked onto a course or activity appropriate to their skills, experience and aspirations.

Clients are responsible for providing accurate information when booking, including information relating to their previous sailing experience, qualifications and any other information relevant to their participation.

Clients must meet any stated pre-course experience, certification or other requirements for the course they have booked.

Clients are encouraged to arrive prepared and ready to participate so that they can gain the maximum benefit from their course or activity. Where recommended pre-course reading, preparation or experience is provided, clients should complete this wherever possible.

Clients should carefully read the course information provided before booking and should contact PASSGC if they are unsure whether a particular course or activity is suitable for them.

PASSGC reserves the right to recommend an alternative course or activity where it considers that the chosen course is not appropriate for the client's experience or aspirations.

Where an activity is provided as an RYA course, the applicable RYA course requirements and standards will also apply.
Special Requirements, Health and Fitness
Clients must inform PASSGC at the time of booking if they have a medical condition, disability or other circumstance that they believe may require special consideration or a reasonable adjustment during their course or activity.

Clients should seek appropriate medical advice if they are uncertain about their ability to participate safely.

Only information reasonably necessary to enable PASSGC to make appropriate arrangements or adjustments will be requested.

Clients must provide accurate and relevant medical information for the duration of their course where required for safety purposes.

PASSGC will make reasonable efforts to accommodate individual requirements where practicable. However, any adjustment or accommodation must be compatible with the safe operation of the vessel and the activity.

PASSGC reserves the right to refuse or modify a client's participation where, in the reasonable opinion of the skipper or instructor, their health, fitness or other circumstances could compromise the safety of the client, other persons on board, the vessel or the safe operation of the activity.
Insurance
PASSGC maintains appropriate insurance for its commercial activities.

Clients are responsible for arranging their own appropriate insurance.

Where applicable, this should include cover for sailing as an activity, personal accident, injury, medical expenses, cancellation, travel disruption, loss of course or activity fees and personal belongings.

Clients should check that their insurance specifically covers the sailing activities included in their booking and any relevant geographical or operational restrictions.

PASSGC strongly recommends that clients arrange suitable travel insurance before travelling to participate in a course or activity.
Sailing Conditions and Operational Decisions
Sailing is dependent upon weather, sea conditions, vessel condition and other operational factors.

The skipper has overall responsibility for the safe operation of the vessel and may alter the planned itinerary, postpone, shorten, relocate or cancel an activity where necessary for safety or operational reasons.

The skipper or instructor's decision regarding the safety of the vessel, crew, clients and activity is final.

Where reasonably possible, PASSGC will offer an alternative date or suitable alternative arrangement where an activity cannot proceed as originally planned.
Cancellation by the Client
All cancellations must be made in writing. Email is acceptable.

PASSGC's cancellation arrangements are intended to be fair and transparent and reflect the costs and commitments involved in preparing and reserving a place on a course or activity.

More than 6 weeks before the start date
The 25% booking payment will be retained.

Between 6 weeks and 4 weeks before the start date
50% of the total booking fee will be retained.

Less than 4 weeks before the start date
100% of the total booking fee will be retained.

Where a client is unable to attend due to illness, injury, travel disruption or other circumstances outside their control, PASSGC may, at its discretion, offer an alternative date or other reasonable arrangement.

Clients are therefore strongly advised to have appropriate cancellation and travel insurance.

A client who fails to attend, arrives too late to participate, or is unable to participate because they do not meet the stated course requirements will normally be treated as having cancelled within the less-than-four-week period.

Where a statutory right of withdrawal applies, that right will be respected. Where a statutory exception to the right of withdrawal applies, the cancellation arrangements set out in these Terms and Conditions will apply.
Nothing in these Terms and Conditions affects any statutory rights that cannot legally be excluded or restricted.
Cancellation or Changes by PASSGC
PASSGC may cancel, postpone or alter a course or activity where circumstances make this necessary, including adverse weather, sea conditions, vessel problems, instructor availability, safety considerations or other circumstances beyond our reasonable control.

Where PASSGC cancels an activity and cannot offer a suitable alternative, clients will be offered a refund of fees paid for the affected activity.

PASSGC will meet any legal obligations that apply to refunds or compensation in these circumstances.

PASSGC will not normally be responsible for additional costs incurred by a client, such as travel, accommodation, flights or other arrangements made independently by the client.
Client Conduct & Safety
Clients must follow all reasonable instructions given by the skipper, instructor or other PASSGC representative.

Clients must behave responsibly and must not deliberately or negligently place themselves, other clients, crew, instructors or the vessel at risk.

Alcohol must not be consumed at any time while the vessel is underway or while sailing activities are taking place. Alcohol may only be consumed once the vessel is securely berthed in a marina and the day's sailing activities have finished.

The possession, use or distribution of recreational drugs is not permitted on board the vessel or during any sailing activity. Clients must not participate in any activity while under the influence of recreational drugs.

Smoking and vaping are not permitted anywhere on board the vessel.

Clients must not interfere with, remove, tamper with or misuse safety equipment or emergency equipment unless instructed to do so by the skipper or instructor.

Clients must not deliberately or negligently interfere with the safe operation of the vessel.

PASSGC reserves the right to require a client to cease participation or leave the vessel where their behaviour presents a safety risk or seriously affects other clients or crew.

No refund will normally be provided where participation is terminated because of a client's unacceptable behaviour or failure to follow reasonable safety instructions.
Damage or Loss of Equipment
Clients may be responsible for the reasonable cost of repairing or replacing equipment that is deliberately or negligently damaged or lost by them.

Normal wear and tear and damage arising from reasonable use of equipment will not be charged to the client.
Emergency Contacts
Clients participating in an active sailing course or other sailing activity must provide the names and contact details of two emergency contacts.

Clients should ensure that both emergency contacts know that they are participating in the activity and have appropriate contact information for PASSGC.

Emergency contact information will be handled in accordance with the PASSGC Privacy Policy.
Personal Belongings
Clients are responsible for their own personal belongings.

PASSGC accepts no responsibility for loss of or damage to personal property except where such liability cannot legally be excluded.

Clients are advised not to bring unnecessary valuables onto the vessel.
Photography & Video
PASSGC may take photographs or video during courses and activities.

Clients will be given the opportunity through the booking process to provide or decline consent for the use of identifiable photographs or video for PASSGC promotional and marketing purposes.

Consent for marketing use is optional and will not affect the client's ability to book or participate in a course or activity.
Data Protections & Privacy
PASSGC collects and processes personal information necessary to provide its services, manage bookings, communicate with clients, maintain safety records and, where applicable, deliver RYA training.

This may include contact information, booking information, emergency contacts, next-of-kin information and information concerning special requirements.

Medical information will only be collected where necessary for safety, appropriate adjustments or other legitimate operational purposes and will be handled securely and only for as long as necessary.

PASSGC will process personal information in accordance with applicable data protection legislation and the PASSGC Privacy Policy.

Where PASSGC provides RYA training, relevant information may be shared with the Royal Yachting Association (RYA) where required for training, certification, quality assurance, inspection, complaint or incident investigation purposes.

PASSGC and the RYA may act as separate Data Controllers for the information they each hold.
The RYA may contact students directly where necessary for quality assurance of RYA training, including the investigation of a complaint or incident.

PASSGC will only collect and retain information that is necessary for the purposes for which it is required and will securely delete or destroy information when it is no longer required, subject to any legal, regulatory, financial or legitimate requirement to retain it.

Further information is provided in the PASSGC Privacy Policy.
Feedback & Complaints
PASSGC welcomes feedback from clients and uses feedback to monitor and improve the quality of its courses and services.

Clients may provide feedback during or after a course or activity and may choose to remain anonymous where the feedback mechanism allows.

Where a complaint arises, clients should raise the matter with the Principal or Chief Instructor as soon as reasonably possible so that PASSGC has an opportunity to address the issue promptly.

Formal complaints should normally be submitted in writing by email or letter.

PASSGC will acknowledge the complaint and investigate it objectively. Where appropriate, the investigation may involve speaking with instructors, other students or independent witnesses.

PASSGC will provide a response setting out the outcome of the investigation and any corrective action considered appropriate.

Complaints relating to an RYA course remain the responsibility of PASSGC to investigate and resolve. Where appropriate, relevant information may be shared with or requested by the RYA for quality assurance, complaint or incident investigation purposes, in accordance with the PASSGC Privacy Policy.
RYA Courses & Certification
Where PASSGC provides a course as an RYA course, it will be delivered in accordance with the applicable RYA course requirements and standards.

RYA certification is subject to the relevant course requirements and, where applicable, successful completion of the required assessment.

PASSGC cannot guarantee that a participant will achieve a particular RYA qualification or certificate.

Where PASSGC becomes an RYA Recognised Training Centre, students undertaking RYA courses will also be subject to the applicable RYA requirements and procedures in force at the time of their course.
Equality, Diversion & Inclusion
PASSGC is committed to providing an inclusive and respectful environment in which clients are treated fairly and with dignity.

PASSGC does not tolerate discrimination, harassment, bullying or abusive behaviour.

Clients are encouraged to inform PASSGC of any special requirements or reasonable adjustments they may need before their course or activity so that appropriate arrangements can be considered.

Any reasonable adjustment must take account of the safe operation of the vessel and the nature of the activity.

PASSGC's Equality, Diversity and Inclusion Policy provides further information.
Safeguarding
PASSGC is committed to safeguarding children, young people and vulnerable adults participating in its activities.

PASSGC maintains a Safeguarding Policy based on relevant RYA safeguarding guidance and will take appropriate action where a safeguarding concern is raised.

Clients, parents, guardians and participants are expected to follow PASSGC's safeguarding requirements and Code of Conduct where applicable.

Further information is available in the PASSGC Safeguarding Policy.

Where PASSGC provides activities to under-18s on a regular basis, its safeguarding arrangements will also reflect applicable Spanish safeguarding requirements. Spanish Organic Law 8/2021 includes specific obligations for organisations habitually carrying out sporting or leisure activities with minors, including safeguarding protocols, monitoring arrangements and a designated protection officer.
Liability
PASSGC takes reasonable steps to provide its services safely and professionally.

Nothing in these Terms and Conditions excludes or limits liability where such exclusion or limitation would be unlawful.

Subject to applicable law, PASSGC will not be responsible for loss or damage arising from circumstances outside its reasonable control or from a client's failure to follow reasonable safety instructions.

These Terms and Conditions do not affect any statutory rights available to consumers.
Applicable Law & Jurisdiction
These Terms and Conditions are governed by the applicable laws of Spain.

Nothing in these Terms and Conditions limits or excludes any mandatory rights or protections available to consumers under applicable law.

Any dispute will be subject to the jurisdiction applicable under Spanish consumer law.

Any dispute should first be raised through the PASSGC complaints procedure so that every reasonable effort can be made to resolve the matter promptly and amicably.
Change to These Terms
PASSGC may update these Terms and Conditions from time to time to reflect changes to its services, legal requirements or regulatory requirements.

The Terms and Conditions applicable to a booking will be those made available to the client at the time of booking, unless a later change is required by law or otherwise agreed with the client.
